Terms of Service (User Agreement)

Introduction

Welcome to ATRAKA Seafarers App (the "App"), a cross-platform application designed to assist seafarers with licensure review, job searching, professional networking, and accessing educational resources.

This User Agreement (the "Agreement") is a legal contract between you ("User," "You") and [ATRAKA PHILIPPINES/ATRAKA] ("ATRAKA," "We," "Us") governing your use of the App and its services.

1. Acceptance of Terms

By accessing, downloading, installing, or using the ATRAKA Seafarers App, you signify that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use or access the App.

2. Description of Services

The App provides users with access to various services related to the maritime industry, including but not limited to:

Licensure Exam Review: Access to study guides, practice tests, and review materials.
Job Search/Job Board: A platform for employers to post maritime job openings and for users to search and apply for those jobs.
Community Forums/Chat: Interactive sections allowing users to communicate, share experiences, and seek advice.
Ebooks & Reading Materials: Access to digital publications and professional articles.
Learning Courses: Structured educational programs provided by ATRAKA or third-party partners.

3. User Accounts and Eligibility

3.1 Account Creation

You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account and use the App. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for safeguarding the password and credentials used to access the App and for any activities or actions under your account. You must notify ATRAKA immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Conduct and Content (UGC)

4.1 Prohibited Conduct

In using the Community Forums, Chat, or any other interactive feature, you agree not to:

Harass, threaten, or abuse other users.
Post or transmit any content that is libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal.
Share copyrighted materials (Ebooks, Courses, Exam Questions) outside of the App.
Post spam, chain letters, pyramid schemes, or unauthorized commercial solicitations.
Impersonate any person or entity.
Engage in any activity that interferes with or disrupts the App or the servers/networks connected to the App.

4.2 User-Generated Content (UGC)

By posting content (including messages, photos, and job reviews) to the App, you grant ATRAKA a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, reproduce, and display that content solely for the purpose of operating and promoting the App. You are solely responsible for all content you post.

5. Intellectual Property and Licenses

5.1 ATRAKA Content

All content provided within the App, including Courses, Ebooks, Review Materials, software, logos, and design, is the exclusive property of ATRAKA or its licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the App content solely for your personal, non-commercial use.

5.2 Restrictions

You may not copy, reproduce, distribute, sell, license, or otherwise exploit any content from the App without the prior written consent of ATRAKA. Any attempt to reverse engineer or modify the review materials or courses is strictly prohibited.

6. Job Board Disclaimer

The App's job board acts solely as a venue for employers and seafarers to connect.

ATRAKA does not screen job listings, and we make no representations or guarantees regarding the truthfulness, accuracy, or validity of any job postings or candidate profiles.
ATRAKA is not involved in the actual transaction between employers and candidates. We are not responsible for the hiring decisions made by any employer.
You use the job board at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, ATRAKA shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from (a) the use or the inability to use the App; (b) the cost of procurement of substitute goods and services; (c) unauthorized access to or alteration of your transmissions or data; or (d) any advice or conduct of any third party in the Community Chat or Job Board.

9. Termination

ATRAKA reserves the right to suspend or terminate your access to the App, without prior notice, if you breach this Agreement, or for any other reason, at our sole discretion. Upon termination, your right to use the App will immediately cease.
